Drafted Under Duress: The Spanish Constitution

Journalist, author and activist Dolores Muntané Coca discusses the drafting of the Spanish Constitution, made more precarious by the military threat that overshadowed everything at the time.

You are asking me how people reacted when Franco passed away. I was in Paris at the time, so I can only explain how my family, and the Spanish people I knew, reacted. We were in a state of anticipation. “Good!” “So now what?” “What’s next?” “What do we have to look forward to?”

We were looking forward to freedom, to a fresh start, to something other than The Transition. Our goal was a clean break. That is to say, we wanted a pre-constitutional period, one where the people had a voice. And from that voice, a fresh, transparent and clear constitution would spring. That didn’t happen.

The constitution was a product of those holding onto power, because [Prime Minister] Suárez had already been serving as general director under Franco. I have great respect for the job he did. It was more than the current government, but it wasn’t enough.

The threat of military action was palpable, so what happened? The fathers of the Constitution, men like Miquel Roca and Jordi Soler Tura, they would all admit that the threat of military action was profound and omnipresent. This was not a constitution drafted in the atmosphere of pre-constitutional period.

Sí, crec que t’he entès. Em preguntes com va reaccionar la gent davant de la mort d’en Franco. Jo en aquell moment estava a París. Et puc dir com es va reaccionar a nivell nostre familiar, i de la gent, dels espanyols que jo conegui hi havia expectatives, la principal sensació era d’expectativa de “Bueno, i ara què?, Ara què passarà?” De què teníem ganes?

Evidentment teníem ganes de què hi hagués una obertura, de què hi hagués realment un trencament, que no va ser la transició. sinó un trencament veritable. És a dir, que d’alguna manera es fes un període preconstitucional, en el qual participes el poble i d’aquí en sortís una constitució neta, clara, oberta i la que realment el poble volgués, i això no va passar.

Es van inventar una transició que la van fer els mateixos de dintre, perquè el Suárez ja havia sigut director general de televisió en l’època franquista, tot i els meus respectes perquè va fer força cosa, més que la que estan fent ara. Però no va ser suficient. Després els militars estaven amb l’espasa en alt, i què va passar?

Doncs que els que es van dir els pares de la constitució, com el Miquel Roca o com Jordi Soler Tura o tota aquesta gent, t’explicarien que van estar super condicionats pels militars. No una constitució real i feta per un poble en un període preconstitucional.
